I watched episode 2 of series 3 again last night, I think that I am getting him confused with one of the detectives on Wire In The Blood, iI think that it is the "designer stubble" that threw me. But thanks for trying to put me out of my misery, having said that having now got the Actor's name I do still think he is familiar. Some spook I would make! should be able to recognise somebody straight away!
